Is Your Website ADA Compliant?

ADA Compliance Matters. We’ll help you improve your accessibility.

We currently offer 3 options to improve the accessibility of your website, helping you better serve your customers and avoid potential litigation.

Over the past year there’s been a dramatic increase in the number of lawsuits relating to ADA compliant websites.  Even if your website was built by Checkerboard or another professional agency, no site is always in compliance: policies change and the content and coding is in constant flux.

Business websites are required by law to be accessible by everyone, regardless of disability.  In general, sites should meet Web Core Accessibility Guidelines (WCAG).

These standards require a lot of effort to meet, and are not covered out of the box by WordPress or any other platform. A 2020 report by the WebAIM project ran accessibility tests on the top one million websites, and found that 98.1% of homepages had detectable WCAG failures. That study only looked at the homepages, and focused on the websites of top companies.

What Regulations Exist?

ADA Compliance relates to the Americans with Disabilities Act.  The international standards in digital accessibility are set by the W3C (World Wide Web Consortium) and is called WCAG (Web Content Accessibility Guidelines).  WCAG 2.1 are the Accessibility Guidelines that should currently be met.  This includes alternatives to text, time-based media, adaptability, keyboard accessibility, predictability, input assistance, compatibility, etc.  Find the full list here.

Reduce the Risk of Potential Litigation

Over the past year the number of ADA-related lawsuits has skyrocketed, and the risk of litigation is real.  While we aren’t lawyers, the general recommendation is every business should make a plan to manage web compliance and make a genuine effort towards serving individuals with disabilities.  While no one can completely guarantee your safety from a lawsuit, a compliance plan can greatly reduce your risk.

How to Improve Your Accessibility

We’ve put together 3 primary packages to help you improve your web accessibility and greatly reduce your risk of potential litigation.  These options offer varying degrees of protection.

Level 1

Max Access Plugin

Configure the Max Access WordPress Plugin and Accessibility Toolbar to continually audit your website using AI, and automatically make necessary compliance changes.  Since AI experiences your site differently than a human, there might be a few issues it misses.  You’ll also need to double check after each audit to ensure automated changes didn’t create a new issue on your site.  This solution isn’t perfect, but it will significantly lower your litigation risk.
